MARTIN COUNTY ORDINANCE 2021- 09 AN ORDINANCE AUTHORIZING TEMPORARY LOAD LIMITS ON COUNTY ROADS
SECTION 1. Purpose:
This Ordinance provides for the preservation of county roads and
highways by limiting the gross weight of vehicles operated on Martin County Highways during certain
periods of the calendar year, whenever said roads by reason of deterioration, rain, snow or other climatic
conditions will be seriously damaged or destroyed without the regulation of vehicle weights.
SECTION 2. General Provisions:
A. Upon declaration by the Board of Commissioners of a road emergency, any
vehicle or combination of vehicles shall not have a total gross weight, with load, in excess of
twenty thousand (20,000) pounds, except and unless a written permit has been obtained from the Martin
County Highway Superintendent.
B. This regulation applies to any public road or public highway of the county system of Martin
County except roads or highways in the state highway system of the State of Indiana and highways in the
Federal highway system.
SECTION
3. Exemptions:
A. Exceptions to these regulations may be made by the County Highway Superintendent.
Applications must be in writing.
B. Permittees shall operate and move said specially permitted weight load only upon the
roads and highways of said county system on the route and as directed in writing by the County Highway
Superintendent.
c. This Ordinance shall not apply to any bus which is forty-five (45) feet or less in length.
SECTION 4. Repealer:
A. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby
repealed.
SECTION 5. Severability:
A. If any section provision or part of this ordinance shall be adjudged invalid or unconstitutional,
such adjudication shall not affect the validity of the ordinance as a whole or any section provision or part
thereof not adjudged invalid or unconstitutional.
SECTION 6. Penalty:
A. A person who violates a restriction commits a Class C infraction and shall be levied a fine by a
court of competent jurisdiction in an amount not to exceed Five Hundred Dollars ($500.00).
SECTION 7. When Effective:
This Ordinance shall become effective from and after its passage by the Martin County Board of
Commissioners and its publication in a paper of general circulation as required by Indiana statute.
